Terms of Service
Last updated: [date]
These terms are an agreement between you and [The Good Call Group, LLC — exact legal name], a [state] company ("Good Call", "we", "us"). They cover the Good Call website at goodcallgroup.com, the app at app.goodcallgroup.com, and everything we offer through them (together, the "Service"). By creating an account, booking a request or listing as a pro, you agree to these terms and to our Privacy Policy.
Section 9 applies only to pros. The rest applies to everyone.
1. What Good Call is
Good Call connects homeowners, renters and businesses ("customers") with independent local contractors, tradespeople and designers ("pros").
- We don't do the work. Pros are independent businesses, not our employees, agents or partners. The agreement for any work, including its scope, price, schedule, warranty and payment, is between the customer and the pro.
- We vet pros, but we don't guarantee them. We review each pro before their first job (see section 7). We don't supervise their work and aren't responsible for its quality, safety, timing or legality.
- We route requests. When you send a request, our system (including automated and AI tools) sorts it to a trade and offers it to available pros. The first pro to accept takes the job.
2. Who can use Good Call
You must be at least 18 and able to enter a binding contract. If you use Good Call for a business, you confirm you're allowed to accept these terms for it. Good Call operates only in the markets listed in the app.
3. Your account
- We don't use passwords. You sign in with a 6-digit code we email you. Keep access to your email secure, because anyone who can read it can sign in as you.
- Give us accurate details: name, email, phone and service address. Keep them current.
- You're responsible for activity on your account. Tell us right away at hello@goodcallgroup.com if you think someone else has used it.
4. Membership
- What members get: priority access to Good Call pros, the pro's member rate on labor, no urgency fee, and booking for today and tomorrow. The member rate is a discount each pro sets on their own labor rate. Good Call doesn't set or guarantee any price.
- Price and billing: the monthly price for your market is shown before you join, plus any tax that applies. Membership renews automatically each month and is charged to your payment method through our payment processor, Stripe, until you cancel.
- Cancelling: you can cancel anytime in your account. Cancelling stops the next renewal. You keep member benefits until the end of the month you've paid for. We don't give refunds or credits for partial months unless the law requires it.
- Failed payments: if a payment fails, we'll try again and email you. If it still fails, your membership ends and you book as a guest.
- Price changes: we'll email you at least 30 days before a new price applies to you. If you don't agree, you can cancel before it takes effect.
- Availability isn't guaranteed. Membership gives you priority, not a promise that a pro will be free at a given time. If no pro accepts, we keep working to line one up, and we'll keep you posted.
5. Guests
Where guest booking is open, guests can book visits a few days out at the pro's standard rate, and an urgency fee may apply. Some features, like booking for today and tomorrow, are for members only.
6. Requests, visits and paying for work
- Your request: describe the problem or project honestly and add any photos that help. Make sure the pro can safely reach the work area at the time you picked, and tell us about access, pets or hazards.
- Arrival windows: you pick a 2-hour window. Pros aim to arrive within it, but traffic, earlier jobs and site conditions can cause delays.
- Price: the pro confirms the price with you on site or by phone before starting work. For projects, the pro quotes after a visit. Nothing is agreed until you accept the pro's price or quote.
- Payment for work: you pay the pro directly, in the way you agree with them. Good Call doesn't collect payment for the work and doesn't take a commission from it.
- Cancelling or rescheduling: use the app, and do it as early as you can. Pros may have their own cancellation terms, which they'll tell you about.
- "I need someone now": emergency requests go to pros who take 24/7 calls. If you face immediate danger, such as fire, a gas leak, an electrical hazard or flooding near power, call 911 or your utility first.
7. How we vet pros
Before a pro gets their first job, we review the information they give us. That can include their identity and business details, references or reviews, insurance and, for work that needs one, their trade license, checked with the licensing authority for your market.
Vetting is a screening step, not a guarantee. Licenses are required only for work that legally needs one. Many small repairs don't, and vetted pros without a license may do them. Customers can ask any pro for their license or insurance before work starts.
8. Ratings, photos and content
- You can rate pros after a job. Ratings must be honest and based on your own experience.
- You keep ownership of the photos and text you send. You give us permission to store, display and share them with the pros and admins handling your request, and to use them to run and improve the Service.
- Don't upload anything you don't have the right to share, or anything unlawful, abusive or harmful.
9. Terms for pros
If you list on Good Call as a pro:
- You're an independent business. You decide whether to accept offers, how you do the work, and what you charge. Nothing in these terms makes you our employee, agent or partner.
- Your listing must be accurate, including your business details, trades, service areas, hours, rates, member discount, licenses and insurance. Update it when anything changes, and tell us right away if a license or insurance policy lapses.
- Licenses and law: only take jobs you're legally allowed to do. You're responsible for permits, safety, taxes (including any general excise tax) and the law that applies to your work.
- Offers: offers go out in tiers, and the first pro to accept takes the job. If you accept a job, show up in the window or tell the customer and us as early as you can. Cancelling accepted jobs, or repeatedly missing offers, can lower your place in the offer order or pause your offers for a while, as described in the app.
- Customer details: customer contact details are shared with you only for the job you hold. Use them only for that job. Don't add customers to marketing lists, and don't share their details.
- Fees: listing and receiving jobs is free during launch. We may later offer paid plans, such as Priority. We'll tell you at least 30 days before any paid plan affects you, and it will be optional. Pros who join during our founding window get the founding benefits described at sign-up.
- Location: if you agree, your location is shared with the customer and our admins from when you tap On my way until you check in, finish or stop the job. We may also ask for your location during active jobs, or when a Good Call admin asks and you agree to share. A request sends you an alert, and your location is shared once, only if you tap to share it.
- Documents: the documents you upload, like insurance certificates and license cards, are seen only by you and our vetting team.
- Insurance: you're responsible for carrying the insurance your work and the law require.
We may decline, pause or remove a listing, for example for safety concerns, complaints, inaccurate information or breaking these terms.
10. Things you agree not to do
Don't:
- use Good Call for anything illegal or unsafe
- harass, threaten or discriminate against anyone
- give false information or pretend to be someone else
- try to get around our routing, vetting or member rules
- scrape, copy or resell the Service or its data
- interfere with its security
- send spam or unwanted messages to other users
11. Messages from us
We send account emails and, if you turn them on, push notifications about your jobs. You can turn off push alerts on your device. We don't send text messages. Some emails, like sign-in codes, receipts and job updates, are part of the Service and can't be switched off while you have an account.
12. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't warrant any pro's work, availability, conduct or prices.
13. Limitation of liability
To the fullest extent the law allows:
- We aren't liable for the acts or omissions of any pro or customer, or for any work done or not done.
- We aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data.
- Our total liability for any claim related to the Service is limited to the greater of (a) what you paid Good Call in the 12 months before the claim, or (b) $100.
Some places don't allow these limits, so they may not fully apply to you.
14. Indemnity
You agree to defend and hold harmless Good Call and its owners, employees and agents from claims, losses and costs (including reasonable attorneys' fees) arising from your use of the Service, your breaking these terms, or, for pros, the work you perform.
15. Disputes
- Talk to us first. Email hello@goodcallgroup.com and we'll try to resolve it within 30 days.
- Between customers and pros: we may help, but we're not required to, and any decision about the work is between you and the pro.
- Governing law: these terms are governed by the laws of the State of [Hawaii], without regard to conflict-of-law rules. Any court case goes to the state or federal courts in [Honolulu, Hawaii], unless the law gives you the right to sue where you live.
16. Ending your account
You can close your account anytime by emailing us or from your account settings. We may suspend or close accounts that break these terms or put others at risk. Sections that by their nature should survive, like 8, 12, 13, 14 and 15, still apply after an account closes.
17. Changes to these terms
We may update these terms. If a change is material, we'll email you or show a notice in the app before it takes effect. Using Good Call after that means you accept the new terms.
